Welcome to the Naturally Slim Web site ("Site"). Please review the following terms that govern your use of our Site. Your use of the Site constitutes your agreement to follow and be bound by these terms (the "Agreement").

RETURNS / REFUNDS

Naturally Slim does not offer refunds or returns for purchases made on the Site.

TERMS OF USE

By using the Site, you agree to comply with these Terms of Use and to indemnify Naturally Slim against any claims by third parties arising from or relating to your violation of this Agreement. In general, you must exercise judgment and responsibility with respect to your use of our Site. You may only use the Site for lawful purposes and may not use the Site to harm others.   • Post or transmit any unlawful, threatening, libelous, defamatory, obscene, inflammatory, pornographic, profane material, hate speech, or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.
  • Introduce viruses, trojan horses, worms, or other computer programming routines that damage, interfere with, intercept, or expropriate any system, data, or personal information.
  • Use the Site to gain illegal or unauthorized access to other computers or networks through hacking or other means.
  • Assist or permit any person to engage in any of the activities described above.

You are granted a limited, revocable, and nonexclusive right to create hyperlinks to the Site so long as the links do not portray Naturally Slim or its suppliers or their products or services in a false or misleading manner. Naturally Slim reserves the right to revoke such limited right at any time in its sole discretion.

In the case of application or feature upgrades on the Site, the Site may require you to install specific software or obtain higher quality services (such as a high-speed Internet service, monitor resolution of 1024 x 768, and supported Web browsers). Naturally Slim will disclose changed requirements on the Site and if necessary, email details to members.

SITE CONTENT

The Contents of the Site, and the Site as a whole, are intended solely for personal, noncommercial (other than for the purchase of merchandise or services from our site) use by the users of the Site. You may download or copy the Contents and other downloadable materials displayed on the Site for your personal use only. No right, title, or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the Contents, the Site, or any related software. Unless noted to the contrary, all trademarks, copyrights, and other intellectual property on this Site (including but not limited to the NATURALLY SLIM word mark and logo marks, the TRUE THIN word mark and logo marks, REAL FOOD, RIGHT PORTIONS, and H2ORANGE) are owned by Naturally Slim, Inc. or its affiliates.

Member posting is intended for discussion of Naturally Slim, Naturally Slim’s services, and related topics. All posters must be at least 18 years of age. Members are allowed only one Member Name and Naturally Slim reserves the right to deny any Member Name for any or no reason. Members shall not post commercial speech, requests for donations, mass communications, solicitations, or posts promoting other websites and/or services. Members shall not post any material that, in the sole discretion of Naturally Slim, is abusive, profane, threatening, obscene, false and/or defamatory, or in violation of U.S. law. Members are responsible for the content of their messages.

Naturally Slim may from time to time monitor, review, and in its discretion edit or delete, discussions, chats, and postings on the Site for any or no reason whatsoever; however, Naturally Slim is not undertaking any obligation and assumes no responsibility or liability arising from the content of any such transmissions or for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, hate speech, danger, illegality or inaccuracy contained in any information transmitted to any such locations on the Site. Naturally Slim will cooperate with law enforcement or a court order requesting or directing Naturally Slim to disclose the identity of anyone posting any information or material prohibited by this Agreement. Naturally Slim may also disclose such information if such disclosure is reasonably necessary to protect the rights, property, or personal safety of Naturally Slim, its clients, or the public. Naturally Slim reserves the right to revoke the posting privileges of any member at any time.

You understand that Members may post information that is not verified by Naturally Slim. If a user has any questions about Naturally Slim’s services or products, users should contact Naturally Slim. Naturally Slim does not vouch for or warrant the accuracy, completeness or usefulness of any posting, and is not responsible for the contents of any posting. In particular, Naturally Slim does not guarantee any medical, legal or other professional advice posted herein. Postings express the views of their authors, not the views of Naturally Slim, or any entity or individual associated with it. If a user has any questions about whether or not a Member is sponsored by Naturally Slim, users should contact Naturally Slim.

PRIVACY POLICY

Naturally Slim respects Members Confidential Information. Confidential Information is information that you are required to submit in order to participate on the Site and that is not publicly available. Naturally Slim will not release Confidential Information about its Members except where: (a) the Member consents; (b) Naturally Slim is legally required to do so; or (c) Naturally Slim decides, in its sole discretion that it is necessary or reasonable to contact law enforcement or your Internet service provider.

Members’ internet addresses (IP number) may be logged with each post. Naturally Slim reserves the right to reveal Members’ IP numbers and e-mail address to law enforcement and Internet service providers as necessary or prudent.

USER COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS

All comments, feedback, suggestions, ideas, and other submissions disclosed, submitted, or offered to Naturally Slim on or by this Site or otherwise disclosed, submitted, or offered in connection with your use of this Site or otherwise (collectively, "Comments") shall be and remain Naturally Slim's property. You agree that Naturally Slim may use and/or disclose information about your demographics and use of the Site in any manner that does not reveal your identity. By participating in Site contests, promotions, and/or requesting promotional information or product updates, you agree that Naturally Slim may use your information for marketing and promotional purposes.

You agree that Naturally Slim may send electronic mail to you for the purpose of advising you of changes or additions to this Site, about any of Naturally Slim's products or services, or for such other purpose(s) as Naturally Slim deems appropriate. TERMINATION

Naturally Slim may terminate this Agreement at any time without notice and deny you access to the Site, if in Naturally Slim's sole discretion you fail to comply with any term or provision of this Agreement. Any termination of this Agreement shall not limit Naturally Slim's other rights and remedies available under law or equity. Upon any termination of this Agreement by either you or Naturally Slim, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under this Agreement or otherwise.

GENERAL

­­Naturally Slim may change, move, edit, modify, restrict access to, discontinue or delete portions of, or may add to, the Site from time to time and without notice. Naturally Slim reserves the right to change, modify, add to, delete, or otherwise alter this Agreement at Naturally Slim’s sole discretion at any time. Such changes and/or modifications shall be effective immediately upon their posting and can be viewable by periodically clicking on this link. Please print a copy of this Agreement for your records. Your use of the Site following any such change constitutes your agreement to follow and be bound by the revised Agreement (including the Site Privacy Policy).

SEVERABILITY

If any provision of this Agreement shall be found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

NO WAIVER

A failure on the part of Naturally Slim to enforce any part of this Agreement shall not constitute a waiver of any of Naturally Slim's rights under this Agreement, whether for past or future actions on the part of any person. Only a specific written waiver signed by an authorized representative of Naturally Slim shall have legal effect.

MISCELLANEOUS

Unless otherwise specified and except to the extent Naturally Slim products or services are offered for sale in the United States through this Site, this Site and the Contents thereof are displayed solely for the purpose of promoting Naturally Slim's products and services available in the United States and select foreign markets. This Site is controlled and operated by Naturally Slim from its offices in Garland, Texas.

This Agreement shall be construed in accordance with the laws of the State of Texas, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and federal courts located in Dallas County, Texas.
